Terms of Service

1. Acceptance of terms

By loading circuitbrowsly.lat, starting a measurement, embedding our widget or calling our measurement API (together, the Service), you agree to these Terms of Service and to our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Service.

If you use the Service on behalf of a company, network operator or other organisation, you confirm that you have authority to bind that organisation to these Terms.

2. Description of the service

Circuitbrowsly is a free, browser-based diagnostic tool. It measures:

• download and upload throughput using multiple parallel HTTP streams;
• idle round-trip latency (ping), jitter and probe loss;
• a composite 0–100 network quality score with a confidence figure;
• optional environment details your browser chooses to expose.

The Service runs entirely in your browser. It does not install software, browser extensions or background agents, and it stops all network activity when the test finishes or when you press Stop test.

3. Eligibility and accounts

No account, registration or payment is required for the public speed test. You must be at least 13 years old (or the minimum digital-consent age in your jurisdiction) to use the Service. Enterprise API access may require a separate written agreement and credentials that you must keep confidential.

4. Acceptable use

You agree not to:

• use the Service to attack, overload, stress-test or degrade any network, host or endpoint you do not own or have permission to test;
• run automated, scripted or looped tests at a volume that could be considered abusive, or bypass rate limits;
• point the custom-endpoint feature at a server you are not authorised to send traffic to;
• reverse engineer, scrape, resell or rebrand the Service other than under an enterprise licence;
• interfere with security features, or use the Service in violation of any applicable law, export control or your own network policy.

5. Bandwidth and data charges

A complete test typically transfers between 60 MB and 400 MB, and considerably more on multi-gigabit links, because a faster connection moves more bytes within the same fixed measurement window. The live “Data transferred” counter shows the exact figure in real time.

You are solely responsible for any data charges, overage fees, throttling or fair-use consequences imposed by your internet or mobile provider. If you are on a metered or capped plan, please check your allowance before starting a test.

6. Measurement accuracy and interpretation

We engineer for accuracy: parallel streams, discarded TCP slow-start, differential byte accounting on the high-resolution performance clock, server processing time removed from latency, and statistical outlier rejection. Even so, a browser measurement is bounded by factors outside our control, including:

• Wi-Fi quality, radio interference and the capability of your router;
• device CPU, memory pressure, battery-saver modes and browser extensions;
• VPNs, proxies, corporate filtering and captive portals;
• congestion on your access network, transit paths or at the test endpoint;
• other devices and applications using the same connection during the test.

Results are provided for informational and diagnostic purposes only. They are not a certification of contractual line speed and are not guaranteed to be accepted as evidence by any provider, regulator or court. Where a field cannot be measured — for example because a browser API is unavailable — we state that plainly rather than estimating it.

7. Third-party measurement endpoints

To measure real network paths, the Service sends requests to independent third-party endpoints, which may include Cloudflare’s public speed endpoints, HTTPBin, Google and Microsoft connectivity probes, and IP/geolocation lookup services such as ipify and ipapi. Their availability, performance and privacy practices are their own; we do not control them and are not responsible for them. If an endpoint is blocked or unreachable, the Service automatically falls back or reports the limitation.

If you supply a custom endpoint, you are responsible for that server, its CORS configuration, its bandwidth costs and its lawful use.

8. Intellectual property

The Service, including its measurement engine, interface design, illustrations, copy, scoring methodology and the Circuitbrowsly name and logo, is owned by Circuitbrowsly Inc. and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal or internal business diagnostics.

Your test results belong to you. You may freely publish, share and export them, including our JSON and CSV outputs and printed reports.

9. Enterprise, widget and API terms

Embedded widgets, white-label deployments, continuous monitoring and API access are offered under a separate commercial agreement that will specify quotas, service levels, support windows and fees. Absent such an agreement, no service level is promised and access may be rate-limited or withdrawn at any time. To discuss enterprise use, contact [email protected].

10. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure against every threat, or that measurements will be free of variance.

11. Limitation of liability

To the maximum extent permitted by law, Circuitbrowsly Inc. and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, data-overage charges, service downtime or business interruption, arising out of or relating to your use of the Service — even if we have been advised of the possibility of such damages.

For the free Service, our total aggregate liability for all claims is limited to USD 100. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Circuitbrowsly Inc. from any claim, demand, loss or expense (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or your testing of networks or endpoints without authorisation.

13. Suspension and termination

We may rate-limit, suspend or permanently block access to the Service — with or without notice — where we reasonably believe it is being abused, used unlawfully, or used in a way that threatens the stability of measurement infrastructure. You may stop using the Service at any time; clearing your browser storage removes all locally stored history and preferences.

14. Changes to these terms

We may update these Terms as the Service evolves. The “Last updated” date at the top of this page always reflects the current version. Material changes will be highlighted on the home page. Continuing to use the Service after an update means you accept the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, excluding its conflict-of-laws rules. The state and federal courts located in San Francisco County, California will have exclusive jurisdiction over any dispute, except that either party may seek injunctive relief in any competent court to protect intellectual property or network integrity. Nothing here limits mandatory consumer rights you may have under the law of your country of residence.
